[p.1] This Indenture made the twenty first

day of July A.D. one thousand eight hundred

and seventy three Between Luther L. Greenleaf

and Elizabeth M. his wife of the Town of

Evanston in the County of Cook and State

of Illinois of the first part and Charles A.

Vail, Samuel M. Dingee, Samuel Mitchell,

Thomas B. Morris and Charles R. Stouffer

all of the village of Wilmette in the said

County of Cook, Trustees, parties of the

second part Witnesseth as follows:

Whereas by certain articles of agreement

dated the twelfth day of July A. D. One

thousand eight hundred and seventy two

it was stipulated and agreed as follows:

We the undersigned agree to pay the

sums set to our names respectively for the

erection of a church edifice in the village

of Wilmette according to the following conditions to wit:

1 These subscriptions shall be due and

payable provided the entire amount received

on subscription shall be at least Four

thousand dollars

2 They shall be payable as follows, namely,

one third when the work is commenced

one third when the building is roofed and

enclosed and one third when it is completed

ready for occupancy

[p.2] 3 The location of the church shall be fixed

by the concurring vote of so many of these

subscribers as shall represent at least

two thirds of the whole amount subscribed

4 The church shall for the present be

held in trust by the Executive Committee

of the Wilmette Evangelical Association;

namely, John Stevenson, Alexander

McDaniel, John D. Brown, Samuel M.

Dingee and Thomas B. Morris and their

successors in office and shall be used

and occupied under their direction

5 The subscriptions that may be made

on this paper shall be for the ultimate

and permanent benefit of such religious

denominations as each subscriber here

shall designate at the time of making

his subscription as hereinafter provided:

and if any amounts are left undirected

they shall be divided in the same proportion

as those here designated

6 Whenever any denomination mentioned

in this subscription and represented here

have amount not less than one fifth of

the whole shall see fit to organize a church

and undertake the maintenance of

stated public worship in the village

of Wilmette it may give notice of a

[p.3] desire to terminate this copartnership

in church property to the Evangelical

Association of Wilmette or the officers

thereof. Then one of two courses shall be

open to the Association. First Either to pay

back to the representatives of such denom-

ination the money that has actually been

paid in its interest, or second within

six months of the time of giving such

notice this copartnership shall cease

and determine and the following steps

shall be taken to wit:

(1) The Committee having the temporary

guardianship of the property shall proceed

to sell it at public auction on the premises,

public notice of the time and place of sale

having been given for at least four weeks

by posting up such notice in four of the

most public places in Wilmette

(2) They shall divide the proceeds of

such sale among the religious denomin-

ations represented in this copartnership

according to the amounts actually paid

in in their interest giving each its

pro rata share

(3) These amounts shall be paid to the

Trustees of such denominations in

Wilmette provided churches have been

organized and Trustees elected, otherwise

[p.4] they shall be paid to the Trustees of the

First church of each of these denominations

respectively in the Town of Evanston

to be held sacredly in trust to be used

for the erection of church edifices for

the benefit of such denomination

in the Village of Wilmette.

(4) Should any denomination become the

purchaser of this church property at

such sale, when it shall have complied

with the conditions above specified the

Trustees or executive Committee of the

Evangelical Association of Wilmette shall

convey the property to them to be held by

them for their sole use and benefit.

To all of which above mentioned con-

ditions we hereby agree, and on these

conditions we agree to pay the sums

set by [?] our respective names

Dated this twelfth day of July 1872.

And whereas the parties of the second part

have been duly appointed and elected

successors to the said John Stevenson,

Alexander McDaniels, John D. Brown,

Samuel M. Dingee and Thomas B. Morris

named in the said articles

And whereas the said party of the first

part both agree to convey to the parties

of the second part the hereinafter described

[p.5] piece or parcel of land to be held in

Trust by them and their successors for the

purpose of erecting a church edifice

thereon and to be used and enjoyed by

the Evangelical Association of Wilmette

aforesaid in accordance with the terms

and conditions expressed in the said

articles of agreement

Now therefore the said party of the

first part in consideration of the promises

and of the sum of one dollar by them

in hand paid by the parties of the second

part the receipt whereof is hereby ack-

nowledged doth hereby grant bargain

sell convey and assume unto the land

parties of the second part and their

successors in office all the following

described piece or parcel of land to wit:

Lots seven and eight in Block number

ten in L. L. Greenleaf's Resubdivision

of Blocks twenty nine (29) to thirty four

(34) inclusive in the said village of

Wilmette together with all and singular

the hereditaments and appurtenances

thereto belonging or in anyway appertaining

and all the estate right title and

interest of the said party of the first

part of in or to the said above described

premises

[p.6] To have and to hold the same unto [?]

The said parties of the second part and

their successors upon trust for the uses

and purposes set forth in the aforesaid

articles of agreement

And the said parties of the first part

hereby waive and release any and all

rights in respect to the above granted

lands to them secured by the statutes

of Illinois relating to the alienation

and exemption [?] of Homesteads

In witness whereof the parties

hereto have hereunto set their hands

and seals the day and year first above written

in and for the Town of Evanston in the County

of Cook and State of Illinois do hereby

certify that Luther L. Greenleaf and

Elizabeth M. his wife being of lawful

age and personally known to me as the

persons whose names are subscribed to the

foregoing deed as having executed the

same appeared before me this day in

person and acknowledged that they

signed sealed and delivered the said

instrument of writing as their free and

voluntary act for the uses and purposes

therein set forth and thereby conveyed

and relinquished all their right, title

and interest, dower and homestead

exemption rights in and to the premises

in said deed described.
