Whereas the undersigned Henry A. Dingee of the City and State of New York and Alexander

McDaniels [sic] and Laura N. Kline of Evanston in the State of Illinois parties of the first part

hereto are the owners of the following described parcels of land situate in the County of Cook

and State of Illinois viz. Commencing at the north-west corner of the south section of the

Ouilmette Reservation thence on the north line of said section east sixty-two (62) chains and

eighty (80) links; thence north twenty-five (25) chains and forty-eight (48) links; thence west

sixty-two (62) chains and eighty (80) links to the west line of said Reservation and thence south

on the west line of said Reservation to the place of beginning containing one hundred and fifty-

six acres be the same more or less.

Also commencing at the north west corner of said Reservation and running thence east on the

north line of said Reservation eighteen (18) chains and seventy-eight (78) links; thence south

twenty-six (26) chains and sixty-one (61) links thence west eighteen (18) chains and seventy

eight (78) links; and thence north twenty-six (26) chains and sixty-one (61) links to the place of

beginning containing fifty acres more or less.

And whereas the line of the Chicago and Milwaukee Rail Road passes through said lands, and

Henry W. Blodgett of Waukegan State of Illinois the party of the second part hereto, has, at the

special instance and request of the party of the first part procured the location and establishment

of a station on said land at which one or more of the local trains running on said road shall stop

for the receipt and delivery of passengers by which said location the value of said land is largely

enhanced.

Therefore in consideration of the services of said second party in procuring the establishment of

said station said party of the first party hereby agree to and with said party of the second part his

heirs and assigns that said party of the second shall be deemed to be the owner of an equal

undivided one fourth (1/4) part of said lands, subject however to the payment to said party of the

first part of the sum of two thousand dollars ($2,000) and interest thereon at the rate of six per

cent per annum out of the proceeds of said lands when sold.

It is also hereby agreed between said parties that said lands shall be platted and subdivided into

small lots and parcels suitable for dwellings and business purposes. And the same shall be put

upon the market and sold and the proceeds thereof realized with as little delay as circumstances

will admit. And that for the purposes of such subdivision and sale said Alexander McDaniels

[sic] shall be the agent of all said parties. And the managing proprietor of said property. That

out of the proceeds of the sale of wood and timber cut hereafter from said land or any part

thereof, and from the proceeds of sales of lots, said McDaniels [sic] shall make such

improvements, by opening streets, highways or ditches in said land, as he deems are necessary to

promote the sale of said lands and lots. That in the management of said property said McDaniels

[sic] shall consult with said owners, and parties in interest, and at no time act contrary to the

direction or advice of a majority of them. That out of the one fourth (1/4) of the proceeds of said

sales coming to said party of the second part said McDaniels [sic] shall first lay the said sum of

two thousand dollars ($2,000) and interest to said party of the first part, and the balance of said

proceeds shall be paid to said second party or to such persons as he shall direct.

In Witness whereof the said parties have hereunto set their hands and seals this second day of

March eighteen hundred and sixty-eight.

It is further agreed between the above named Henry A. Dingee, Alexander McDaniel, and Laura

N. Kline, wife of Simon V. Kline, that said Alexander McDaniel is to receive four sixteenths

(4/16) and Laura N. Kline three sixteenths (3/16) of the net profits which may be derived from

the sale of the above described property after paying said Henry A. Dingee all the costs of said

lands; and all other moneys which may be paid out by said Dingee in making improvements from

time to time upon said property; together with interest at the rate of six per cent upon all moneys

so advanced by said Henry A. Dingee upon said described property.

In witness whereof the said parties have herewith set their hands, and seals this second day of

March A.D. eighteen hundred and sixty eight.
