ORDINANCE NO. 2007-O-85
AN ORDINANCE AMENDING THE WILMETTE
VILLAGE CODE, 1993, AS AMENDED, AMENDING
VARIOUS SECTIONS AND SUBSECTIONS OF CHAPTER 6, SO AS TO REVISE THE SOLID WASTE COLLECTION FEES
WHEREAS, the Village of Wilmette is a home rule municipality as provided in Article VII, Section 6 of the Constitution of the State of Illinois, 1970, and may pursuant to said authority undertake any action and adopt any ordinance relating to its governance and affairs; and,
WHEREAS, the Village President and Trustees of the Village Board find that the sound management of the public finances of the Village of Wilmette necessitates that from time to time the Village of Wilmette revise certain user and service fees in order to adequately fund the public services provided by the Village of Wilmette and provide for a system under which those who benefit directly from particular services pay a proportionate share of costs of those services; and,
WHEREAS, the Village President and Trustees of the Village Board further find that the cost of providing for the collection of household solid waste and household recyclable solid waste from detached dwellings and certain other multi-family non-commercial properties in the Village of Wilmette is substantial and continues to increase, and that the increase in fee for such service contemplated in this Ordinance will defray a portion of the cost of providing said solid waste collection service, and that collection of said increased fee for service will better apportion the costs of said service between those receiving the benefit of said service and all the taxpayers of the Village of Wilmette who otherwise must finance the costs of said service; and,
WHEREAS, the Village President and Trustees of the Village Board further find that the imposition and collection of such user and service fees is intended by this Ordinance, and shall operate as a fee collected to defray the actual costs of services rendered by the Village of Wilmette or its contractors paid by the Village of Wilmette, and is not intended, shall not be administered and otherwise shall not constitute nor be interpreted as a tax on either occupations, services or property, both real or personal;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES of the Village of Wilmette, Cook County, Illinois:
SECTION 1: Each of the foregoing recitals and findings are hereby made a part of this Ordinance and are incorporated by reference as if set forth verbatim herein.
SECTION 2: The Wilmette Village Code, 1993, as amended, is further amended in Chapter 6, "Finance," Section 6-9, "Service and User Fees," Subsection 6-9.2, "Solid Waste Collection Fee," further Subsection 6-9.2.2, "Amount of Solid Waste Collection Fee," by deleting the text shown in strikethrough and inserting the new text shown in underlined bold type below, so that said further Subsection 6-9.2.2 shall hereafter read as follows:
6-9.2.2 AMOUNT OF SOLID WASTE COLLECTION FEE.
The amount of Solid Waste Collection Fee shall be as follows:
(a) For detached dwellings, the Solid Waste Collection Fee shall be $14.9015.65 per month or any portion thereof, said Solid Waste Collection Fee to be billed and paid in installments of $44.7046.95 per calendar quarter or pro rated fraction thereof.
(b) For each dwelling unit that is part of a multi-unit dwelling that receives individual solid waste collection service and individual water service metered for separately for that dwelling unit as described in Section 6-9.2.1(a)(1), the Solid Waste Collection Fee shall be $14.9015.65 per month or any portion thereof, said Solid Waste Collection Fee to be billed and paid in installments of $44.7046.95 per calendar quarter or pro rated fraction thereof.
(c) For multi-unit dwellings wherein each dwelling unit that is part of the multi-unit dwelling that does not receive individual solid waste collection service and individual water service metered for separately for that dwelling unit as described in Section 6-9.2.1
(a)(2), the Solid Waste Collection Fee to be paid by the entity responsible for payment of the water service bill for that multi-unit dwelling shall be the total of $14.9015.65 per month multiplied by the number of all the dwelling units in the multi-family structure, said Solid Waste Collection Fee to be billed and paid in installments of $44.7046.95 per calendar quarter times the number of all the dwelling units, or pro rated fraction thereof.
SECTION 3: This Ordinance shall be in full force and effect from and after January 1, 2008, subsequent to its passage, approval and publication as required by law.
