SECTION 6â€"NON-CONFORMING USES................_ The lawful use of a building or premises existing at the time of the adoption of this Ordinance may be continued, al- though such use does not conform with the provision hereof, and such use may be extended throughout the building or premises. " Non-conforming uses may be changed to a use that is permitted in the dis- trict wherein the last preceding . use' is permitted, providing 411 other regulations governing the use are complied with. SECTION 7â€"HEIGHT DISTRICT REGULATION - In the residence^ district no buiWing shall exceed thirty-five (35) feet inbeight and within this height- shall contain not more than a basement^and two and one-half (2%) stories, with the follow- ing exceptions: (a) Public buildings, buildings for re- ligious worship and schuuls, may fee erected to a height not exceeding sixty (60) feet, provided that such structures â- will have side yards on all sides, as re- quired under Section 11 (b). Such build- ings may have towers, domes or spires extending above said sixty (60) feet, but not more than pne hundred (100) feet from the ground. SECTION 9â€"HEIGHT IN "B" ^COM- MERCIAL DISTRICT; AND HEIGHT â- SSfâ€"'^G^- INDUSTRIAL^ JDISTRICT,______ In the commercial district, and in- dustrial district, no building shall ex- ceed forty-five (45) feet in height, and within this height, shall contain not more than a basement and three and one-half (3%) stories, with the following1 ex- ception: (a) Chimneys, pent-houses, water towers, and like structures may extend to such height above the forty-flve (45) foot level as the practical operation thereof may require, provided that the nearest point of such structure to any street line shall be not less than its height above the forty-five (45)__foot leveL_______........._........_._!...... _......-........"1_~-.Il._-.~~ SECTION 10â€"AREA REGULATIONS. In order to regulate and limit the in- tensity of the use of lot areas, and to regulate and determine the area of yards, courts, and other open spaces* within and surrounding buildings in the Village of Wilmette, no building shall be erected or altered in such a manner as to vio- late the limits herein provided in the district in which such building is lo- SECTION 11â€"INTENSITY OF USE OF "LOT AREAS IN~^A" TIESIDENCE" DISTRICT (a) FRONT YARD: The minimum distan«e^^from^^he^^ronting=street line to the front of any building shall not be less than the average in the same bitiek when one-half or more "of the lots inthe block are then occupied and in no case shall be less than fifteen per cent (15%) of the depth of the lot nor less than twenty-five (25) feet. The front of the building as used 4n this paragraph means the front surface either of the main portion of the building or of any porch, vestibule, bay window or like portion of the building extending more than six (6) feet above grade. - (b) SIDE YARD: There shall be a side yard on each side of the lot hav- ing a width of not less than three (3> feet, provided, that if the building is higher than thirty-five (35) feet as specified in Section 8 (a), then the width of the side yard must be increased one al) loot fot^each additional loot_in height above thirty-five (35) feet. (a) Buildings or portions of buildings to be used exclusively for mercantile or industrial purposes may occupy the en- tireâ€"area-ofâ€"the-lotr-------------- â€"â- â- ' (b) Any story or stories to be used partially or wholly as tenements shall occupy not more J;han__ sixty per cent (60%) of the area of an Interior lot, or seventy per cent (70%) of a corner lot. __ (c) Every building or portion of a building to be built or altered for use as a tenement, shall have inrier-and-oufe- er courts in accordance with such or- dinances as may be then in effect. SECTION 13â€"OCCUPANCY PERMITS No land shall be occupied or used, and no building hereafter erected or altered, shall be occupied or used in whole or In part for any purpose whatsoever until a certificate shall have been issued by the Superintendent of Public Works, stating /?* that the building' complies with all the troilding-attd--health- laws-^md-ordinance^ and with the provisions of these regula- tions.No change of use shall be made in any building or part thereof now or hereafter erected or altered that is not consistent with the provisions of these regulations. Nothing in this section shall prevent the continuance of the present occupancy or use of any exisiting build- ing, except as may be necessary for safety of life and property. Certificates for occupancy and com- pliance shall be appied for coincident with the application for a building per- mit, and shall be issued within ten (10) days after the erection or alteration of such buildings shall have been completed; ^ A record of all certificates shall be kept on file in the office of the Superintendent of Public Works, and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected. A fee of two dollars ($2.00) shall be charged for each original certificate, and one dollar ($1.00) for each copy thereof. No permit for excavation for, or the erection of, any building shall be Issued bejfore application has ben made/ for.... certificate of occupancy and compliance. No building or premises may be occu- pied until such certificate shall have been issued. ___ -______ SECTION 14â€"PLATS All applications for building permits shall be accompanied by a plat in duplicate drawn to scale showing the actual dimensions ofâ€"the lot to be built upon, the size of the building to be erected, and such other information as may be necessary to provide for the en- forcement of these regulations. A care- ful record of such applications and plats shall be kept irj the office of the Superin- tendent of Public Works. No yard, court, or other open space provided about any building for the purpose ot complying with the provisions of these^ regulations shall again be used as a yard, court, or other open space for another building. SECTION 15â€"USE PERMIT No change 'shall be made in the use of ^t Isuildihg^without-a^perinltihaving nrst been issued by the Superintendent of Public Works, and no permit shall be issued to make such a change "unless^ it is in conformity with the provisions ot this Ordinance or amendments thereto hereafter duly enacted.
